I’m grateful for the opportunity to clarify the laws and regulations for the Kuwaiti society, providing both expats and Kuwaiti citizens with a better understanding of their rights and obligations in various daily scenarios they might encounter.
Today I will be answering some questions regarding working hours and working days under the Kuwait labor law. The answers are only applicable for the private sector, although some other sectors do have similar laws and regulations.
Question: I am currently working 12 hours a day, for 6 days a week without a break, sometimes even 7 days a week if there is an emergency. Is this legal? Am I entitled to overtime pay?
Fajer: Yes you are entitled to overtime pay, as the maximum working hours under the labor law are 48 hours of work per week, and 8 hours per day. This is implemented for both physical and mental work. Therefore, the maximum working days are 6 days per week. The employer must provide one hour break for every 5 hours of consecutive work a day. Twenty-four hours of break must be provided once a week, and they must be continuous.
Overtime is also calculated for any additional hours to the 48 hours mentioned by law. There is also a limit to how many hours you work overtime — it is two hours per day, with a maximum of 180 hours a year, and three days a week or 90 days a year. The calculation for overtime is 1.25 times your salary for overtime worked on regular days, 1.5 times your salary for hours worked on your day off, and 2 times the basic hourly rate for all hours worked on public holidays.
Q: I am working 26 days a week, and my boss when calculating my salary, divides it into 30 days. Is this the correct way to do it?
Fajer: No. If you are working 26 days a week, then your monthly salary should be divided by 26 days and not 30 days.
Q: Our company policy states that I am only entitled to 30 days off per year, and I can only go on holiday after working for 9 months. Is this correct?
Fajer: It is only correct that you are entitled to a minimum of 30 days off a year, but an employee is eligible after 6 months of working and not 9 months, as per the Kuwait labor law amendments.

In an address on World Environment Day at the Indian Embassy on Sunday, June 5th, Ambassador Shri Sibi George said India is not part of the climate change challenges, but is part of the solution.
Compared to the global average, India has a 60% lower carbon footprint per capita. Despite India's role in addressing climate change, Ambassador Vasu said, the nation is part of the solution and has gone above and beyond what it should have.

World Environment Day, he said, aims to celebrate India's contributions to Climate Action, to recognize India's progress in Climate Action among Kuwaiti friends and diasporans, and to raise awareness about climate change across the Kuwaiti community including among children, a key issue facing the world today.
The ambassador also pointed out that Kuwait can play a significant role in expanding India's energy security partnership. Moreover, India will be able to make some progress in Kuwait's engagement with India in this sector with Kuwait joining the International Solar Alliance, which was conceptualized at India's initiative.

As temperatures soared across the country today, the electrical indicator touched the yellow line for the first time this year, crossing the threshold of 15,000 megawatts.
In the peak season last year, the electricity index reached 15,040 megawatts, an increase of almost 600 megawatts over last year's maximum load.
The load during peak season could be as high as 16,700 megawatts, according to sources.

Dust storms are a regular occurrence in Kuwait in June as the month is locally branded “the month of bawareh” and the dusty weather is also witnessed in July, said Dr. Hassan Dashti, the weather monitor at the national meteorology center on Sunday. Hot weather distinguishes a long summer in the country, particularly sensed with onset of June, when the high atmospheric pressure recedes in favor of the the Indian low pressure that extends to Africa and continues until end of September, Dashti said.
Summer season is characterized with rain absence, high heat and strong winds, namely “Al-Bawareh” that begin to blow late May with “Al-Bareh Al-Sagheer (small)” and proceeds until mid-July with “Al-Bareh Al-Kabeer (grand)” that triggers dust storms, amid very hot northwesterly winds. The high heat is due to movement of the Indian low pressure winds toward Zagros Mountains, where the wind loses its heat due to compression at the high elevation at a rate of six degrees per a km.

According to an official source the government is able to reduce food, consumer and construction prices in the country by 10 to 20 percent through many means, reports Al-Qabas daily. The same source said this can be done by working to reduce or temporarily waive the customs duties charged by the General Administration of Customs; cessation of handling fees, flooring fees and others on the main importers of basic materials and local manufacturers; providing storage facilities for local companies and importers, especially that their cost is high and therefore it has a great bearing on the final price of the commodity sold to the consumers.
The source pointed out that this proposal was discussed by the Council of Ministers after what was proposed by the Ministry of Commerce and Industry through an advisory team affiliated with the Minister’s office, but ended up in the drawers to collect dust. In addition, Al-Qabas learned that in 95 percent of the cases of the Ministry of Commerce and Industry’s records of seizures (artificially raising prices) during the past two years, which were registered against companies, suppliers, or commercial stores and referred to the Public Prosecution have reportedly ended up in calling the suspects innocent.

Statistics published in 2021 by the Kuwait Real Estate Union showed there were 61,000 vacant apartments in Kuwait, compared to 335,100 occupied flats that constituted 84.6 percent of total apartments. “Prices in residential areas are stable and even rising, while investment areas have witnessed a fall of 10 to 15 percent in rental value,” real estate expert Sulaiman Al-Dulaijan told Kuwait Times.

“Between 80,000 and 100,000 expats left the country during the pandemic due to several economic factors, which affected rental values in investment areas. The slump did not affect citizens in residential areas due to the stability of their income during the pandemic,” he said. Dulaijan mentioned the average rent for a 60 sqm apartment in Hawally governorate is KD 270 to KD 300.
“High-quality decor, services, location and the availability of parking spaces impact the value of the rent, which can increase to KD 400 or higher,” said. “We have only a tenancy law that governs the relationship between the owner and the lessor, otherwise there is no official party in Kuwait that determines the rental value,” he added.
“Despite a 10 to 12 percent fall in investment apartment rents in the last six months, prices are still high according to the area and lack of services in investment buildings,” real estate broker Salem Al-Barki told Kuwait Times. “Meanwhile, prices in residential areas are still maintaining their high prices, and demand has increased due to the better services provided, such as parking lots and free water and electricity,” he said.
Barki explained that although residential areas have better services, many tenants are facing strict conditions despite agreeing to pay high rents. “Even if the tenant accepts a high rent, they are facing problems with owners regarding the number of people allowed to live in the flat. Some of them refuse to rent to families with more than one kid, or to divorced women, even if the lessor is a Kuwaiti,” he said.
Regarding the apartment pricing method, Barki said: “It depends on several elements including market price, supply and demand, owner’s pricing and agreement between the parties. Entities that are responsible for the real estate sector can help reduce the units’ prices by passing a law that sets the price of the apartment according to the area and the services provided with the investment.”
Regarding the reason for high rents in residential areas, real estate office employee Abu Ahmad told Kuwait Times that “lessors have started to increase rents in residential areas more than investment apartments, which led to rising demand on residential properties and higher prices”. He said prices saw a slight decrease in investment areas. “But based on the apartment space, rental prices are considered high,” he said.
“After a slight decrease in apartment rentals, the average rent for a 60 square meter flat in Salmiya is KD 360 to KD 380 per month. As for residential apartments in areas such as Rumaithiya, it is between KD 500 and KD 550 per month,” Abu Ahmad added.
Abu Ahmad told Kuwait Times about the violations committed by real estate owners. “The Municipal Council determines the size of the apartment, but after the electricity is connected to the property, the owner divides the apartment be become two apartments instead of one, and prices them as if it is one big apartment, which leads to high prices,” he said. “The Municipal Council obligates property owners to provide tenants a parking space in the basement, but after they get the building license, they transform it into storage areas and rent them to outsiders, while ignoring the tenants’ needs for parking spaces.”
Another real-estate office employee, Mustafa Ahmad, said a lack of construction workers led to a rise in their daily wages and eventually increased the contractor’s total cost. “Ultimately, his issue affects rental prices, but tenants can still rent according to their budget. Despite a lack in the services provided to lessors, prices are not low,” he said.

The Occupational Safety Center affiliated to the Public Authority for Manpower began surprise campaigns to arrest workers who work directly under the summer heat, reports Al-Qabas daily. The daily added on the first day of the campaign which began on June 1, the inspectors issued 40 violations to construction workers and said 47.5 percent of these workers were found to be holding No 20 visa (domestic workers).
The daily added, the ban period during summer includes from noon until 4:00 pm and came into effect on June 1, 2022. During the campaign, which was headed by Hamad Al-Makhial, in the suburb of South Abdullah Al- Mubarak, which is witnessing extensive construction and building work, a number of violations were issued to companies that are not committed to hiring workers during the afternoon.

A U.S. Embassy tweet of a rainbow-flagfestooned message by President Joe Biden in support of Pride Month has drawn a face-to-face diplomatic protest from Kuwait and sparked a rare Twitter fight between the two close allies. On Friday, U.S. diplomats were doubling down with rainbow flag postings and statements in support of LGBTQ rights on social media. The messages appeared in response to the Kuwaiti government’s official objection the day before to what Kuwait’s state news agency called the “pro-gay rights post” of the U.S. Embassy there.
“The United States stands with the LGBTQI+ community everywhere around the world,” State Department spokesman Ned Price said in a pointed retweet Friday of the embassy’s original offending Pride Month message. The dispute began after the U.S. Embassy in Kuwait posted a tweet Thursday that called Biden a champion of LGBTQI rights.

The Embassy of India held a Cycle Rally on World Bicycle Day, June 3rd, as part of Azadi Ka Amrit Mahotsav-Celebrating 75 Years of India's Independence and also on the 60th anniversary of the establishment of diplomatic relations between India and Kuwait, to highlight the simplicity, affordability, reliability, and environmental friendliness of cycling as a mode of transportation that promotes health and wellness.
The Indian Embassy was the starting point for the diplomatic area's cycling rally. The event had previously begun with flower homage to Mahatma Gandhi. "We're holding this cycle rally to commemorate India's 75th year of independence," Ambassador Shri Sibi George stated at the rally's launch at India House. He stated that the bicycle rally is part of India's attempts to raise awareness about the many environmental initiatives implemented by the country.

The Ministry of Foreign Affairs on Friday disowned a lady alleging on the social media to be belonging to the Kuwaiti diplomatic corps and supporting the Trans people. The lady in question belongs neither to the diplomatic corps nor to the Ministry of Foreign Affairs of Kuwait, according to a press release from the MoFA.
The diplomatic passport the lady holds is no longer valid; she got it when her father was working for a technical office of a government body affiliated to an embassy. The contract of the man was terminated and his diplomatic passport as well as those of his family were invalidated, the statement affirmed.(KUNA)

The Ministry of Health of Kuwait opened Kuwait's first oncology department outside the Kuwait Cancer Center at Jaber Hospital - a facility available to citizens from all parts of the country. Kuwait's Cancer Control Center, Al-Saeed announced in a press release on Wednesday, would provide services to citizens across the country.
This opening corresponds to the Ministry's plan to facilitate and improve the provision of health and medical services to all Kuwaitis, based on the best standards of quality, within the framework of the Ministry's continued efforts to improve health service quality in Kuwait and, more generally, in accordance with the four pillars of Kuwait's development plan. Medical equipment, devices, and specialized staff are available at the facility.
As a result of the sincere efforts of health sector cadres in different sectors, efforts are also underway to set up another oncology department at Jahra Medical City. In fact, he pointed out that there are patients who have already been examined in Jaber Hospital after its opening thanks to the presence of medical staff and devices such as PET SCAN machines, which are the most accurate for detecting cancers.

A Kuwaiti visa agent allegedly tortured a woman from Tirupati, who was traced to the Indian Embassy in Kuwait by the Indian Consulate in Kuwait.
In a report on Wednesday, the New Indian Express reported that an Indian visa agent had held captive Sravani from Tirupati in Kuwait. The report mentions that she sent her husband a video message complaining of harassment and being locked in a room by the agent. A frustrated maid's husband in India reached out to the local media based on the video clip.
In the meantime, after seeing the news report, the Indian Embassy in Kuwait managed to trace her and flew her back to India the same night. According to sources at the Indian Embassy in Kuwait, Sravani arrived safely in India on Wednesday night and joined her husband.
Sibi George released a WhatsApp helpline number earlier this month as part of the Indian Embassy's outreach program. These WhatsApp numbers can even be used to send voice messages to the Embassy in any of the Indian languages so that it can trace them. These helplines should be used by community members as a means of contacting Embassy in an emergency.

As all of us know Fish is one of the most nutritious foods available. This is due to the fact that it is high in protein, vitamins, and good fats. Those who enjoy fish and seafood may have to rethink their eating habits in the coming days due to an extraordinary price spike that has infuriated consumers.
The price has increased from May 17 and just over two weeks ago. Zubaidi price, sea food has increased like a gold price. A kilogram fish costs KD20, compared to KD13 for imported Zubaidi fish and KD4.500 for grouper costs.
The price of local Zubaidi was KD14 per kilogram at the time. This means that the price has risen by 42%. As a result, KD20 is no longer sufficient for a consumer to purchase fish; he must set aside a bigger sum. For local people Zubaidi is too costly to consume, local people cannot afford it.

The Ministry of Higher Education (MoHE), from 2015 until 2021, has discovered 140 forged certificates that were submitted for accreditation through the automated systems implemented by the Ministry to authenticate university degrees for 133 people, reports Al-Qabas daily. The Undersecretary of Higher Education, Dr. Subeih Al-Mukhaizeem, said the ministry’s efforts were to develop and implement mechanisms to combat forgery in university and professional certificates, and to set objective criteria for their equivalency, in a discussion session of the Public Anti-Corruption Authority (Nazaha), in the presence of its president, Eng. Abdulaziz Al-Ibrahim and its Acting Secretary General, Dr. Muhammad Buzbar. Al-Mukhaizeem revealed the ministry has won 93% of the cases filed against it from certificate holders whose certificates were refused equivalency, for not meeting the necessary conditions, especially those issued by the Philippines, India, Slovakia and the University of Athens in America, while other cases are pending before the courts.
During the presentation, Al-Mukhaizeem confirmed that the ministry, in turn, is taking the necessary measures for the forged certificates and referring them to the Public Prosecution, indicating that it has referred all the files it has to the legal authorities, in addition to following up on the merits of the investigations.

The Criminal Evidences Department, in cooperation with the Department of Info Systems at the Ministry of Interior, launched Wednesday, the service to issue criminal status electronically on the ‘Sahel’ platform which is fortified with QR security code to verify its authenticity for use inside and outside the country, reports Al-Qabas daily. The Public Relations and Security Media Department of the ministry said in a press statement this service comes based on the directives of the First Deputy Prime Minister and Minister of Interior, retired Lieutenant-General Sheikh Ahmad Nawaf Al-Ahmad Al-Sabah, and under the followup of the Undersecretary of the Ministry, Lieutenant-General Anwar Al-Barjas.
The department stressed the ministry’s keenness to launch this new service to effectively contribute to the success of the country’s efforts in digital transformation to save time and effort of all citizens and residents and complete their transactions with ease. She added that this also comes in line with the ministry’s strategy to automate all public services in line with the technical and technological leap that the security establishment to speed up the completion of transactions.
